Litigation & Appeals

Morristown, New Jersey Divorce Litigation and Appeals Attorneys

At Cutler, Townsend, Tomaio & Newmark , we understand that often the issues involved in divorce disputes must be resolved through litigation and appeals. Our litigation attorneys understand the intricacies of divorce litigation and take the time to explain the advantages of and pitfalls of litigation in relation to mediation and arbitration.

New Jersey Divorce Litigation Attorneys

Divorce litigation (like all litigation) is a process. The first step in a divorce proceeding is the same whether the final resolution is a result of litigation or alternative dispute resolution (ADR). The process begins by filing a complaint for divorce or response to the initial pleading. Then there is a period of discovery where assets are identified, valued and an exchange of information.

Often at this point, our New Jersey divorce litigation lawyers can determine whether litigation will be necessary. If we need to go to court to freeze assets and request temporary support payments, it is often at that divorce litigation is necessary.

However, New Jersey courts require mandatory mediation in divorce dispute. We make every effort to resolve child custody, child support, and asset division issues in this forum. When the issues are intractable we aggressively pursue our client’s interests. Our litigation attorneys make every effort to obtain the best possible result during the initial litigation process.

New Jersey Divorce Appeals

A divorce judgment can be appealed in an effort to overturn a trial court ruling. Our divorce litigation attorneys have significant experience handling divorce appeals in the Appellate Division of the Superior Court, as well as the Supreme Court. None the less, divorce ruling are more often affirmed than reversed. In cases where decisions have the possibility to cause serious damage, such as asset division of a business, we can file to prevent the judges order from taking effect while the cases is on appeal.
